Website plagiarism on the rise

Make a claim using the new cost effective route - the alternative to the expensive intellectual property litigation in the high courts.

Due to the current economic climate smaller businesses or those looking to cut costs have found it quite difficult to guard their copyright. The Patents County Court have brought forward new, cost effective ways which will facilitate those smaller businesses protect their copyright or online service of a website.

The latest venture by the Patents County Court plans to limit fixed costs and award damages of £5k or less for cases involving intellectual property.

This cheaper, faster service follows recommendations made in Hargreaves Review, Digital Opportunity: A Review of Intellectual Property and Growth, to which evidence presented found that smaller businesses found it easier to pay licensing fees on a patent that may be invalid than to dispute or challenge the patent. This was due to the high costs and 1 in 6 smaller businesses had given up attempting to enforce their rights and those that did go to court, less that 1 per cent gained a favourable court decision.

The government have accepted the recommendations made by Hargreaves Review and announced that they will help those smaller organisations protect their intellectual property rights. This gives an opportunity for smaller companies to concentrate on their business and give them a sense of confidence and security to protect their intellectual property rights in a cost effective manner.

An additional development targeted at smaller businesses includes the enhancement of existing schemes such as mediation to provide a more efficient dispute resolution service that can prevent potentially costly legal cases.
